Terms and Conditions

An initial non-refundable deposit of 30% of the total cost is required to confirm and hold a reservation.  (non-refundable deposit of 50% is required for orders of $1000.00 and above.) The remaining balance is due 30 days prior to the event date for cake orders and 15 days prior for dessert table orders. We must receive the balance by 5 pm EST on the due date indicated to begin working on the order.  Failure to do so will result in the cancellation of the order, the contract will be null and void, and the deposit will not be refunded. The balance due date is the final date to cancel and request changes to the order, such as event date,  size, style, or flavors. 

Cancellation received after the balance due date(s) will not be subject to refund. CakeSpell Delightful Baking, LLC adheres to local and federal guidelines regarding the COVID-19  pandemic. In the event of pandemic enforced restrictions, we, CakeSpell Delightful Baking, LLC, will work with the client to reschedule the date. We reserve the right to exercise artistic license and make last-minute changes, if necessary, to guarantee the structural, visual, and creative integrity of the cake and/ or the dessert table. If fresh flowers will be used on the cake, it is the responsibility of the florist to determine flower safety and safe food practices and not CakeSpell Delightful Baking, LLC. Cake serving size is an estimation and is not guaranteed to be exact. 

CakeSpell Delightful Baking, LLC  cannot design a replica of the cake image. Images serve as a visual guide of the desired design. Cakes designed by CakeSpell Delightful Baking, LLC may be used at our discretion and we hold intellectual rights thereof. In the event of an emergency, should we fail to deliver your cake or desserts on the date requested, a  refund for the full amount will be issued. In case of an unavoidable situation, such as a car accident or poor road conditions during delivery, CakeSpell Delightful Baking, LLC cannot be held liable for more than the cost of the above-ordered cake. Delivery and setup services are required for wedding cakes and dessert tables. Services are also available for cake orders of $200 and above and prices vary by location ($0.56 per mile for the first 20  miles and $1.00 per mile thereafter in addition to any tolls that may be applicable). 

If the event is outside our service area, we will deliver it to the client and allow them or the designated representative to transport it to the location. If you or your designated representative elects to transport and set up your cake or desserts, you assume all liability and responsibility for the condition of the cake or desserts once it leaves our possession. We are not responsible for any damages to the cake or desserts once it has been picked up or after the setup is complete. You are responsible for providing an appropriate and secure table, transportation, and room condition;  with an optimal room temperature of 75 degrees or below. 

Terms and Conditions Our products may contain or come into contact with milk, wheat, nuts, soy, and other ingredients. You agree to notify your guest of this risk and hold us harmless for allergic reactions. 

Equipment: 

Security Deposit: If your cake or dessert table requires equipment such as candy jars, cake plates,  stands, etc.; a security deposit is required to ensure the safe return of the equipment. We will return the security deposit when the equipment is returned to us in its original condition no later than 48 hours past the event date. The security deposit is forfeited if the equipment is not returned by the “equipment return date” specified in the contract. For your convenience, we also offer breakdown and pick up after the event. If you select this service, the security deposit will be returned on that day. 

Equipment Terms: The above equipment rate is per day. By submitting payment, you agree to the following terms: 1. to keep and maintain the equipment during the terms of the rental at your expense.  2. To fully compensate CakeSpell Delightful Baking, LLC for replacement and/or repair of any equipment which is not returned because it is lost, stolen, damaged, and in need to be restored to the condition at the time of the rental. Should the equipment become damaged, your security deposit will be forfeited, and should the damages exceed the security deposit, you will be invoiced for the remaining cost. 

Finally,  you indemnify and hold CakeSpell Delightful Baking, LLC harmless for all injuries or damage of any kind for repossession and all consequential and special damages for any claimed breach of warranty. You shall pay all reasonable attorney and other fees, the expenses and costs incurred by CakeSpell Delightful  Baking, LLC, or its agent in the protection of its rights under this rental agreement and for any action taken for CakeSpell Delightful Baking, LLC to collect any amounts due under this rental agreement. 

By submitting payment, full or partial, you authorize CakeSpell Delightful Baking, LLC to process your payment via Square and agree to adhere to the terms and conditions above.
